1. Acceptance of Terms
By downloading, accessing, or using Peak Looks (the "App"), you confirm that you are at least 13 years of age and agree to be bound by these Terms of Service ("Terms"). If you are between 13 and 18 years old, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. If you do not agree to these Terms, you must not access or use the App.
2. About Peak Looks
Peak Looks is a looksmaxxing application that uses artificial intelligence — including image-to-text reasoning and text-to-text models powered by xAI APIs — to provide personalized appearance analysis and recommendations. The App is available on iOS and Android via the Apple App Store and Google Play Store. All AI-generated outputs are for informational and self-improvement purposes only and do not constitute professional medical, dermatological, or cosmetic advice.
3. Eligibility & Age Requirements
You must be at least 13 years old to use Peak Looks. Users under 18 must have verifiable parental or guardian consent. We reserve the right to terminate any account we reasonably believe belongs to a user under the age of 13. By creating an account, you represent and warrant that you meet the applicable age requirements and that all information you provide is accurate and complete.
4. Account Registration
To access certain features of the App, you must create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately at support@peaklooks.com if you suspect any unauthorized use of your account. We are not liable for any loss or damage arising from your failure to keep your credentials secure.
5. Subscriptions & Payments
Peak Looks offers free and paid subscription tiers. Paid subscriptions are processed through Stripe (for web purchases) and through Apple App Store or Google Play in-app purchase systems where applicable. By subscribing, you authorize us to charge your selected payment method on a recurring basis at the then-current subscription rate. All fees are stated in U.S. dollars unless otherwise indicated. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. Refunds are subject to the refund policy of the platform through which you purchased.
6. AI-Powered Features & xAI APIs
The App uses xAI's API services to power image analysis and text-based recommendations. When you submit a photo or text prompt, that content may be processed by xAI's systems in accordance with xAI's terms and privacy policies. Peak Looks does not guarantee the accuracy, completeness, or fitness for any particular purpose of AI-generated outputs. You acknowledge that AI analysis is probabilistic and may contain errors, biases, or inaccuracies. You should not rely solely on AI outputs for any decisions affecting your health, appearance, or well-being.
7. User Content & Photo Submissions
By uploading photos or other content to the App, you grant Peak Looks a limited, non-exclusive, royalty-free license to use, process, and transmit that content solely for the purpose of providing the App's services to you. We do not sell or share your photos with third parties for advertising purposes. You represent and warrant that you own or have the necessary rights to submit any content you upload, and that such content does not violate any third-party rights or applicable law.
8. Prohibited Uses
You agree not to: (a) use the App for any unlawful purpose; (b) submit photos or content of any individual without their explicit consent; (c) upload content depicting minors in any inappropriate context; (d) attempt to reverse-engineer, decompile, or extract source code from the App; (e) use automated scripts or bots to access the App; (f) use the App to harass, bully, or demean any person based on their appearance; (g) circumvent any technical measures we use to restrict access. Violation of these prohibitions may result in immediate account termination.
9. User Responsibility
You are solely responsible for your use of the App and any outcomes resulting from actions you take based on App recommendations. Peak Looks is an informational tool. Any changes you make to your appearance, lifestyle, skincare routine, diet, or any other aspect of your life based on App output are undertaken entirely at your own risk. We strongly encourage consulting qualified professionals — such as dermatologists, nutritionists, or licensed aestheticians — before making significant changes.
10. Intellectual Property
All content, design, logos, trademarks, software, and features of Peak Looks are owned by or licensed to Peak Looks and are protected by copyright, trademark, and other applicable intellectual property laws. Nothing in these Terms grants you any right to use Peak Looks branding or proprietary content without prior written permission. Feedback, suggestions, or ideas you submit to us may be used by us without restriction or compensation to you.
11. Third-Party Services
The App integrates with third-party services including Supabase (database and authentication), Stripe (payment processing), xAI (AI inference), Apple App Store, and Google Play Store. Your use of these services is subject to their respective terms of service and privacy policies. We are not responsible for the practices or content of any third-party service. Links to third-party websites or services are provided for convenience and do not imply endorsement.
12. Disclaimer of Warranties
THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE APP WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. PEAK LOOKS DOES NOT WARRANT THAT AI OUTPUTS WILL BE ACCURATE, RELIABLE, OR APPROPRIATE FOR YOUR SPECIFIC SITUATION.
13. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, PEAK LOOKS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF DATA, REVENUE, GOODWILL, OR PERSONAL INJURY — ARISING OUT OF YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF $50 USD OR THE AMOUNT YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM.
14. Indemnification
You agree to indemnify, defend, and hold harmless Peak Looks and its affiliates, officers, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to your use of the App, your violation of these Terms, your submission of any content, or your violation of any rights of another.
15. Termination
We reserve the right to suspend or terminate your access to the App at any time, with or without cause or notice, including for violation of these Terms. Upon termination, your right to use the App ceases immediately. Provisions of these Terms that by their nature should survive termination will survive, including intellectual property, disclaimer, limitation of liability, and indemnification sections.
16. Governing Law & Disputes
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any dispute arising from these Terms or your use of the App shall be resolved through binding individual arbitration under the rules of the American Arbitration Association. You waive any right to participate in a class action lawsuit or class-wide arbitration. Notwithstanding the foregoing, either party may seek injunctive relief in a court of competent jurisdiction for matters involving intellectual property.
17. Changes to Terms
We reserve the right to update or modify these Terms at any time. When we make material changes, we will notify you via in-app notification or email. Your continued use of the App after the effective date of revised Terms constitutes your acceptance of the changes. We encourage you to review these Terms periodically.
